Congress Claims 'Rational Basis' for Challenged DOMA Restriction

Congress has fired back in a suit challenging the constitutionality of the definition of marriage in the Defense of Marriage Act. In a motion to dismiss, former Solicitor General Paul D. Clement argues that the act is entitled to a presumption of constitutionality.
